Terms of Service

Marketist provides privacy-first web analytics software as a service (“Service”). The Service enables website owners to collect aggregated, anonymized analytics about their visitors without storing personally identifiable information.

By creating an account, you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Service.

You agree not to use Marketist to:

• Track visitors on websites you do not own or have authority to instrument
• Attempt to de-anonymize or re-identify website visitors
• Circumvent the privacy protections built into the tracker (DNT respect, opt-out, IP anonymization)
• Use the analytics data for targeted advertising, profiling, or discriminatory purposes
• Interfere with the Service infrastructure or other users' accounts
• Violate any applicable law or regulation

You own your data. The analytics data collected via your tracker embed belongs to you. Marketist does not claim ownership of your analytics data and will not use it for any purpose other than providing the Service to you.

You may export your data at any time via the Privacy Settings page. Upon account deletion, all your data is permanently erased within 30 days.

The Service is provided “as is” without warranties of any kind, express or implied. Marketist shall not be liable for:

• Loss of data due to hardware or software failure
• Inaccuracies in analytics data
• Service interruptions or downtime
• Indirect, incidental, or consequential damages arising from use of the Service

Our total liability to you shall not exceed the fees paid by you to Marketist in the 3 months preceding the claim.

These Terms are governed by the laws of the Federal Republic of Germany, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Frankfurt am Main, Germany.

If you are a consumer in the EU, you retain the protection of mandatory consumer protection laws in your country of residence.

We will notify you of material changes to these Terms by email at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
